1. Introduction

These Terms & Conditions govern your use of Infyntra, a cloud infrastructure design and management platform operated by AHMEDMEDIAGROUP LTD, a company incorporated in England and Wales. By accessing and using Infyntra, you agree to be bound by these terms. If you do not agree to these terms, please do not use the service.

2. Definitions

For the purposes of these Terms & Conditions:

Service means the Infyntra platform available at app.infyntra.io, including all features, tools, and functionality provided therein.
Website means the Infyntra marketing website available at infyntra.io.
Account means your user account registered on the Service.
Content means all data, designs, configurations, documentation, and other materials you create, upload, or transmit through the Service.
User means any individual or entity accessing or using the Service or Website.
Subscription means a paid plan or free tier providing access to the Service.

3. Account Registration

3.1 Registration Requirements

To use the Service, you must create an Account. Registration is required for all tiers, including the free tier. You agree to provide accurate, current, and complete information during the registration process and to maintain the accuracy of such information.

3.2 One Account Per Person

You may maintain only one Account for personal use. You are responsible for all activities that occur under your Account. You agree to keep your password confidential and to notify us immediately of any unauthorized use of your Account or any other breach of security.

3.3 Eligibility

By registering an Account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms & Conditions. If you are registering on behalf of an organization, you represent that you are authorized to do so.

4. Acceptable Use

You agree not to use the Service in any way that:

Violates any applicable law, regulation, or third-party rights.
Abuses, harasses, threatens, intimidates, or harms any individual or group.
Attempts to reverse engineer, decompile, disassemble, or otherwise discover the source code or underlying algorithms of the Service.
Performs automated scraping, crawling, or data harvesting without explicit written permission.
Circumvents, bypasses, or disables any security measures, access controls, or rate limits.
Transmits malware, viruses, worms, or any other malicious code.
Engages in any form of unauthorized access, data theft, or fraud.
Uses the Service for commercial purposes without authorization, including resale or redistribution of the Service.

Violation of these acceptable use policies may result in immediate suspension or termination of your Account without refund.

5. Subscription & Billing

5.1 Subscription Plans

Infyntra offers monthly and annual Subscription plans. Details of each plan, including features and pricing, are available on the Pricing page. Free tier access is also available with limited features.

5.2 Payment Processing

All payments for Subscriptions are processed by Paddle, which acts as Merchant of Record. By purchasing a Subscription, you authorize Paddle to process payment on behalf of AHMEDMEDIAGROUP LTD. Your payment information is subject to Paddle's Privacy Policy and terms of service.

5.3 Price Changes

We reserve the right to change Subscription prices at any time. For existing Subscribers, price changes will take effect at the renewal of your current Subscription period. We will provide at least 30 days' notice of any price increase. If you do not agree to a price change, you may cancel your Subscription before the change takes effect.

5.4 Taxes

All pricing is stated exclusive of applicable taxes. Paddle is responsible for calculating, collecting, and remitting any taxes due in accordance with applicable law. Your invoice will include any applicable taxes calculated by Paddle.

5.5 Recurring Billing

Subscriptions renew automatically at the end of each billing period unless cancelled. You are responsible for cancelling your Subscription before the renewal date to avoid being charged for the next period.

6. Intellectual Property

6.1 Ownership of the Service

AHMEDMEDIAGROUP LTD retains all right, title, and interest in the Service, including all software, code, designs, documentation, and features. The Service is protected by copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any ownership rights therein.

6.2 Your Content

You retain all right, title, and interest in any Content you create, upload, or transmit through the Service. By uploading Content to the Service, you grant AHMEDMEDIAGROUP LTD a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your Content solely for the purpose of providing the Service to you.

6.3 License to Use the Service

Subject to your compliance with these Terms & Conditions, AHMEDMEDIAGROUP LTD grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business purposes.

7. User Data & Content

7.1 Ownership of User Content

You retain ownership of all infrastructure designs, configurations, documentation, and other data that you create and store within the Service. We do not claim ownership of your Content.

7.2 Use of Anonymized Data

We may collect, analyze, and use anonymized and aggregated data derived from your use of the Service to improve our products, services, and infrastructure. This data will be aggregated and anonymized so that it cannot be used to identify you or your organization.

7.3 Data Retention During Subscription

Your Content is retained on our servers while your Account is active. You are responsible for maintaining backups of any critical data.

7.4 Data Export and Deletion

Upon request, you may export your Content from the Service. Upon termination of your Account, your Content will be retained for 30 days, during which time you may request an export or data deletion. After 30 days, your Content will be permanently deleted from our systems.

8. Service Availability & Support

8.1 Service Availability

We use reasonable efforts to maintain the availability and performance of the Service. However, we do not guarantee uninterrupted service or 100% uptime. The Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control.

8.2 Scheduled Maintenance

We may perform scheduled maintenance on the Service with reasonable notice. We will make commercially reasonable efforts to schedule maintenance during off-peak hours and will provide notice of major maintenance activities when possible.

8.3 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service or any features thereof at any time. We will use reasonable efforts to provide notice of material changes.

9. Limitation of Liability

9.1 Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AHMEDMEDIAGROUP LTD makes no warranties, representations, or conditions of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free from viruses or malicious code.

9.2 Limitation of Damages

In no event shall AHMEDMEDIAGROUP LTD be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or business interruption, even if advised of the possibility of such damages.

9.3 Cap on Liability

Our total liability to you for any claim arising out of or related to these Terms & Conditions or your use of the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim, or £100, whichever is greater.

9.4 No Liability for Infrastructure Decisions

AHMEDMEDIAGROUP LTD shall have no liability for any infrastructure, security, or architectural decisions made by you or any organization using the Service. You are solely responsible for all decisions regarding your infrastructure design, configuration, and deployment.

10. Termination

10.1 Termination by You

You may terminate your Account and Subscription at any time by accessing your Account settings or by contacting us. Termination takes effect immediately. No refunds will be issued for partial months or unused portions of annual Subscriptions, except as required by applicable law.

10.2 Termination by Us

We may terminate your Account immediately, without notice, if you violate these Terms & Conditions, engage in fraudulent activity, or use the Service in a manner that harms our systems or other users.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will retain your Content for 30 days, during which time you may request an export. After 30 days, your Content will be permanently deleted unless you have requested otherwise.

10.4 Survival

The following sections survive termination of these Terms & Conditions: Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and any other section that by its terms is intended to survive.

11. Indemnification

You agree to indemnify, defend, and hold harmless AHMEDMEDIAGROUP LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your Content, or your violation of these Terms & Conditions.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. We will provide notice of material changes by posting the revised terms on the Website and updating the "Last updated" date. Your continued use of the Service following the posting of revised Terms & Conditions constitutes your acceptance of the changes. If you do not agree to the revised terms, you may terminate your Account.

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales, without regard to its conflicts of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising out of or relating to these Terms & Conditions.

16. Severability
